Our Terms of Use is a crucial element of our learning platform. It will help you understand how we operate and engage with our learners or students, who are all active members of our association. It also contains vital information about your legal rights, obligations, and possible solutions. Please read the contents of this page carefully.
Our Terms of Use set forth the terms on which we will provide access and use of the website to users of our services. By agreeing to these terms or by otherwise accessing or using academy.opticare.com.au (the “Website”) or any other linked pages, landing pages, features, content, or application services offered by Opticare, you then acknowledge and agree to be bound by these Terms of Use and Our Privacy Policy.
The website and our Terms of Use shall be governed by and construed in accordance with the laws of the State of New South Wales.
1. Scope of Services
a. Opticare Academy is an online learning platform that offers free and paid courses to Opticare members.
b. Opticare Academy’s course catalogue is viewable by the public but to access the courses, learners need to be active members of the association.
c. Opticare Academy may grant any of the following proof for module/training/program completion: certificates, badges, grades, letter of recommendation, and other materials to evidence merit/reward/incentive.
d. Learners will have a student profile that is visible to their instructors.
e. Learners can log in to a student dashboard for them to view their learning progress and other details of the courses and services that they access on the platform.
f. Learners and instructors can interact with each other if they are all in a course together.
g. Learners can opt out of a course or program at Opticare Academy. In the case of paid courses, refunds will have to be discussed with Opticare.
h. Most of the modules at Opticare Academy are designed to fit the schedule of working members and can be taken at learners’ own convenience. However, some programs may follow a schedule which will be stated in the program details.
i. Other users of the online learning platform are the instructors which are all pre-assigned by Opticare. Instructors have their own Instructor Profiles and dashboard.
2. Use of the Directory Website, Eligibility, and Verification of Business
a. By accessing or using Opticare Academy, a user represents and warrants that he/she is 18 or older and has the legal capacity and authority to transact online.
b. The website is to be used for lawful purposes. Opticare Academy prohibits access to the directory website to:
i. steal information from others, particularly fellow users;
ii. violate the rights of others;
iii. abuse, harm, or exploit children; and
iv. spread, solicit, or exchange information or any materials that are false, malicious, obscene, vulgar, hateful, discriminatory, or can be used as an accessory to cause harm or commit a criminal act.
c. We may limit or deny a user the use and access of the website or any features if found to have committed the aforementioned.
d. Users will comply with applicable laws within their state, including those related but not limited to online use, privacy and safety, electronic communications, fraud and abuse, cyber intelligence, and child protection and safety.
e. Users are responsible for the security and confidentiality of their profile login details. Opticare Academy, on the other hand, will never share your login details with any third-party group or with anyone not authorised by you.
g. Computer viruses, computer or device malfunction, or any other issues resulting from accessing files or content from the website are outside our control. While we secure that the entire platform is safe and protected from any malicious files and content, we cannot guarantee the change in the characteristics of files during transmission. Upload and download information at your own risk.
3. Promotions
a. To promote Opticare Academy and increase our learning platform's exposure, links leading to it may be displayed on other websites, in applications, within emails, and in online and offline advertisements.
b. On the other hand, Opticare Academy and other promotional materials, especially blogs and news articles, may contain links leading to third-party websites or resources (“Third-Party Services”). Such Third-Party Services may be subject to different terms and conditions and privacy practices. We are not responsible or liable for the availability or accuracy of such Third-Party Services or the content, products, or services available from such Third-Party Services. Links to such Third-Party Services are not an endorsement by Opticare Academy of such Third-Party Services unless communicated as a cross-promotion, sponsorship, or partnership promotion.
4. Copyright Infringement.
All modules and programs are owned by the association. If certain materials or media like videos, photos, or music are incorporated within the modules or programs, Opticare Academy represents and warrants that a valid license to use such media was secured.
Opticare Academy will respond to clear and complete notices of alleged copyright or trademark infringement.
5. Fees and Payments
a. Setting up a Student or an Instructor Account is free.
b. Modules or programs may either be free or paid.
c. Payments for paid modules or programs are facilitated by Stripe, a global financial services company providing payment processing software and application programming interfaces for e-commerce websites and mobile applications.
d. Opticare Academy’s services are open to Australia only therefore, the following applies:
i. Only credit cards issued in Australia may be used for payments.
ii. Opticare Academy will not be liable for any fees that a Customer may incur when attempting to use a credit card that was issued abroad.
iii. Opticare Academy will not be liable for any fees that a student may incur if penalised by Stripe or your credit card company for any suspicious acts done while using the website.
e. Any payments or payouts that will take place within Opticare Academy are for the purpose of purchasing or accessing a paid module or program therefore, the following applies:
i. No other payments or payouts for any other food type, goods, or services must be exchanged and facilitated within the website app. Payments and payouts for other goods and services are strictly prohibited, and if such transactions are found, Opticare Academy reserves the right to ban the user involved from using the website app.
ii. Opticare Academy also reserves the right to perform the necessary legal actions against the said parties for violating the allowed transaction within the platform.
iii. Opticare Academy also reserves the right to charge the said parties for any damages resulting from such prohibited transactions.
iv. Opticare Academy is not liable for any financial damages incurred by a user while accessing the online learning platform.
6. Payment Gateway
Opticare Academy’s payment gateway is Stripe, a global financial services and software company used and trusted by many online-based service websites, marketplaces, and e-Commerce sites similar to Opticare Academy.
As a general rule, all users of Opticare Academy should accept the terms set forth within the Stripe Services Agreement (SSA). It is an essential part of our Terms of Use and is the main guideline covering the entire payment process within Opticare Academy.
7. General Community Guideline
a. Be respectful, fair, truthful, and kind when interacting with others through our chat portal, social media pages, and other online or offline channels.
b. Adhere to Opticare Academy’s Terms of Use and other policies.
c. Be active in reporting any activities that violate our Terms of Use and other policies.
d. Be active in providing feedback to Opticare Academy regarding errors or issues encountered whilst using the website app.
e. Be responsive and cooperate with Opticare Academy representatives when resolving issues and disputes.
f. Being inappropriate and sending obscene or offensive materials that intend to sexually harass, demean, expose, disrespect, or extort another user of Opticare Academy.
g. Mining contact information and other personal details of other users of Opticare Academy.
h. Accepting payment or incentives for modules or programs on behalf of Opticare Academy.
i. Using credit cards that you are not authorised to use.
j. Hacking through others’ credit card information.
k. Passing on malicious bots, programs, computer viruses, and other online attacks through our chat portal, our social media pages, and any other online or offline channels.
8. Indemnification
You agree to release, indemnify, and hold Opticare Academy and its sponsors or partners along with their employees, management, and directors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
i. your breach of our Terms of Use;
ii. your improper use of the Opticare Academy online learning platform;
iii. your improper observance of website, promo mechanics, and other activity regulations; or
iv. your interactions, including transactions and communications with another user of the website.

Our Terms of Use page was last updated on the 18th of April, 2022.
We may modify or update our Terms of Use without any prior notice. All changes will be communicated accordingly.
